My understanding is that you have to evidence that the person in care had a "medical" need or "healthcare reason" for care - ie they needed more than just a safe place to stay where they were given a little help to wash and dress and have 3 meals a day. If the person in care needed any health care - regular GP visits, nursing care, hospital admissions or specialist appointments or they needed quite a lot of supervision in the care home to manage their behaviour (if they have dementia and their behaviour is in any way challenging - wandering, escaping, noisy, disruptive etc) this can mean they should have had NHS funding. By and large, there are massive holes in the assessment process. Lots of people who should have had funding haven't. Many haven't even been assessed!
What happens if my grandma was assessed and they said her needs were social and we would have to pay? Does that mean we have to keep paying til the money from her house sale runs out?
Your grandma may not have been assessed properly and you might be able to get some of the fees refunded. There are lots of different reasons why the assessment may have been flawed. You should to talk to someone about this.
